In today's litigious society, it is imperative to have Errors and Omissions insurance: it's not a luxury; it's a necessity. Your association-sponsored plan gives you the protection you need and the service you deserve. FTJ can tailor a plan to suit your association's or group's special needs.

Educator’s Professional Liability.

You have access to this valuable protection if you are a member of a participating association.

What’s Covered?

With the Educators' Professional Liability Plan, you will be protected against a broad range of exposures associated with your educational duties, including the following allegations :

  • Injuries to students under your supervision
  • Improper placement of students
  • Improper methods employed in instruction, counseling, research design, etc.
  • Defamation
  • Hiring unqualified persons
  • Failure to educate
  • Failure to promote students or grant credit
  • Violation of student civil rights
  • Negative consequences in the implementation of the recommendations of research studies
Also,
  • If you supervise other employees and are sued by one of them regarding covered personnel matters, the policy will pay 90 percent of your defense costs for a maximum of $5,000, subject to a $100 deductible.
  • The plan will pay up to $250 for your initial consultation with an attorney, and it will pay up to $750 of the cost of having an attorney represent you at a formal hearing of a school board or other authority if you are threatened with with a job action, such as a termination, suspension, reassignment or demotion.
  • You also will receive up to $4,000 for legal fees, subject to a $100 deductible, if you decide to sue because of the job action and the judgment in the suit is in your favor. Of that $4,000, $750 is available to you regardless of the suit's outcome. 

This plan does not respond to criminal actions (except as noted below), corporal punishment where prohibited by law, or to acts or omissions with respect to work carried on as a part-time private consultant unless you have applied for coverage as such and paid the appropriate premium. (See below for more information about additional part-time coverage.)

Three Additional Features.

After a $100 deductible, the plan pays 90 percent of your attorney’s fees if you are accused of the following:

  • A suit demanding non-monetary relief (Up to $35,000 for defense costs).
  • Sexual abuse; provided you are found not guilty or the charges are dismissed ($35,000 annual maximum).
  • Criminal charges arising out of corporal punishment, provided you are found not guilty or the charges are dismissed ($10,000 annual maximum).

Who’s Eligible?

Regular coverage — any member of one of our sponsoring educational associations who is a W-2 employee of an educational entity; i.e., school, university or college. This must be your main occupation. Owners and board members are not eligible for coverage.

Only registered nurses, licensed/certified school psychologists and physical therapists performing medically related teaching or services in the normal course of their duties as an employee of a school are eligible for coverage.

Additional Part-time Coverage Available. 

If your primary employment is with an educational organization, you may cover part-time educational jobs (consultant, tutor or teacher) by paying a modest additional amount. The part-time work must be of a nature similar to your regular responsibilities.

To be eligible for the additional part-time coverage, the following requirements must be met:

  • The position must be your part-time or secondary job, it must be educational and not medical related, and must fall within the same underwriting guidelines as your main occupation.
  • You must receive payment for the job.

What’s My Coverage Amount?

Choose $250,000, $500,000, $1 million or $2 million per claim in protection. Defense costs are paid in addition to this amount.

When Does My Coverage Apply?

Your plan will provide coverage for claims brought at any time, as long as the occurrence that resulted in litigation occurred while your Educators' Professional Liability policy was in effect. You’ll be covered even if you’ve dropped the coverage – as long as your coverage was in force when the incident happened.

Other Insurance.

The insurance provided by this plan is in excess of any other valid and collectible insurance or indemnity you might have with regard to the claim, including coverage provided by your school district and/or school board.

Please Note.

If you are an educator primarily in private practice, an independent contractor or a school psychologist interested in additional coverage for a part-time private practice, you are not eligible for this plan, but we now have a plan for which you may qualify. A surplus lines tax is included in your premium. This plan is available only to members residing in the U.S. and the District of Columbia.

This plan becomes effective the first of the month after receipt of the enrollment form and payment.

NSA attracts members with a wide variety of practices. One of the best aspects of this diversity is that it challenges the association to be flexible and responsive — qualities that must be reflected in a professional liability program.

After months of research, including input from the Insurance Committee, the Board of Governors, and individual members, FTJ developed a program for NSA that meets the needs of members. The result is a basic plan that addresses the exposures NSA members most frequently face.
